Terms of Service for Sublyze

Introduction

Welcome to Sublyze. These Terms of Service ("Terms") govern your use of the Sublyze mobile application ("App") and services provided by Sublyze ("we," "us," or "our"). By accessing or using Sublyze, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using Sublyze, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years old to use Sublyze (16 in the European Economic Area). By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

If you are under 18, you must have parental or guardian consent to use the App.

3. License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Sublyze for personal, non-commercial purposes.

You may NOT:

• Modify, reverse engineer, or decompile the App
• Use the App for any illegal or unauthorized purpose
• Remove any copyright or proprietary notices
• Attempt to gain unauthorized access to our systems
• Use the App to create content that violates others' rights
• Use automated tools (bots, scrapers) without permission
• Create multiple accounts to abuse free credits

4. Account Registration

Apple Sign-In:

• Authentication is exclusively through Apple Sign-In
• You must have a valid Apple ID to create an account
• You authorize us to access your Apple ID information
• Apple's terms and privacy policies also apply

Account Security:

• You are responsible for all activities under your account
• Notify us immediately of unauthorized access
• You may not impersonate others or create fake accounts

5. Credits and Subscriptions

Credit System:

• Sublyze uses a credit-based payment system
• Free credits provided upon signup (3 credits)
• 1 credit = 1 video processing (regardless of duration)
• Credits are non-refundable and non-transferable
• Credits have no cash value
• Unused credits expire upon account deletion

Subscription Tiers:

• Basic (Free): Limited credits, watermarked videos
• Pro (Paid): Additional credits, watermark removal, priority processing

Payments:

• All payments are processed through Apple App Store
• Subscriptions auto-renew unless cancelled
• Prices are displayed in your local currency
• Cancellations take effect at the end of the billing period

Refunds:

• Refund requests are handled through Apple App Store
• Contact Apple Support for refund inquiries
• We may grant refunds at our sole discretion
• No refunds for consumed credits or completed services

6. Video Content and Usage

Your Content:

• You own the videos you upload to Sublyze
• You have the right to use and process these videos
• You will not upload content that infringes on others' rights
• You will not upload illegal, offensive, or harmful content

Content Restrictions:

You may NOT upload content that:

• Violates intellectual property rights
• Contains illegal material
• Depicts violence, hate speech, or harassment
• Contains adult or explicit content
• Violates any applicable laws

Generated Content:

• You retain ownership of videos you create using Sublyze
• Videos are stored for 7 days for your convenience
• After 7 days, videos are automatically deleted
• Download your videos before they expire

License Grant to Us:

You grant Sublyze a limited, non-exclusive, worldwide license to store and process your videos solely for subtitle generation and service delivery. This license terminates when videos are deleted (after 7 days or manual deletion).

7. Service Availability

We strive to provide reliable service, but:

• Service may be temporarily unavailable for maintenance
• We do not guarantee uninterrupted access or 100% uptime
• Video generation times may vary based on demand
• We reserve the right to modify or discontinue features with notice

8. Intellectual Property

Our Property: The Sublyze App, including its name, logo, design, features, and content, is owned by Sublyze and protected by copyright, trademark, and other intellectual property laws.

Your Property: You retain all rights to the videos you upload and the videos you create using Sublyze.

Copyright Infringement: We respect intellectual property rights. Report copyright violations to: hello@sublyze.online

9. Prohibited Activities

You agree NOT to:

• Use the App for any illegal purpose
• Upload content depicting violence, hate speech, or illegal activities
• Attempt to circumvent payment systems
• Interfere with other users' experience
• Use the App to train competing AI models
• Extract or reverse engineer our AI algorithms
• Overload or interfere with service infrastructure

Violation of these terms may result in immediate account termination and legal action.

10. Account Termination

Your Rights: You may delete your account at any time through Settings → Delete Account. Note: Active subscriptions must be cancelled before deletion.

Our Rights: We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.

11. Disclaimers

The app is provided "as is" and "as available" without warranties of any kind.

We disclaim all warranties, including:

• Merchantability and fitness for a particular purpose
• Accuracy of AI-generated subtitles
• Uninterrupted or error-free service
• Security or freedom from viruses

AI Accuracy: Subtitle generation is provided by AI and may contain errors. We do not guarantee 100% accuracy. You are responsible for reviewing and correcting subtitles.

12. Limitation of Liability

To the maximum extent permitted by law, Sublyze shall not be liable for any indirect, incidental, special, or consequential damages arising from:

• Your use or inability to use the App
• Loss of data or content
• Your violation of these Terms
• Unauthorized access to your account
• Third-party actions

Our total liability does not exceed the amount you paid in the last 12 months.

Exceptions: These limitations do not apply to gross negligence, willful misconduct, death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.

13. Indemnification

You agree to indemnify and hold Sublyze harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your uploaded content
• Your violation of any third-party rights

14. Dispute Resolution

Governing Law: These Terms are governed by Turkish law. EU residents: EU consumer protection laws apply. International users: local laws may also apply.

Informal Resolution: Contact us first to resolve disputes: hello@sublyze.online. We will attempt good faith resolution within 30 days.

Arbitration: Disputes may be resolved through binding arbitration in Istanbul, Turkey. Small claims court option available.

Class Action Waiver: Disputes are resolved individually, not as class actions.

15. Changes to Terms

We may modify these Terms at any time by posting updated Terms in the App and updating the "Last Updated" date. Continued use of Sublyze after changes constitutes acceptance of the new Terms.

16. Privacy and Data

Your use of Sublyze is subject to our Privacy Policy, which is incorporated into these Terms by reference.

17. Third-Party Services

We use third-party services (Apple, RevenueCat, Fal.ai, Cloudflare, Expo). Review their terms before using the App. We are not responsible for third-party service failures.

18. App Store Terms

You acknowledge that:

• These Terms are between you and Sublyze, not Apple
• Apple has no obligation to provide support for Sublyze
• Apple is not responsible for the App or content
• You comply with all applicable third-party terms when using Sublyze
• Apple is a third-party beneficiary of these Terms
